One-time Federal Bureau of Investigation Staff Member Claims Unlawful Termination Because of LGBTQ+ Flag Display

A long-serving Federal Bureau of Investigation analyst has initiated a lawsuit stating his dismissed because of having a rainbow symbol within his desk area.

Based on the former employee, that worked in the agency since 2009, his termination earlier this year is being described as “illegal and discriminatory”.

Judicial Proceedings Claims Constitutional Infringements

The complaint contends that the FBI violated Maltinsky’s First Amendment protections and engaged in disciplinary action toward him for participating in legally safeguarded expression.

The plaintiff is seeking a judicial directive to return his employment within the agency.

Details from the Lawsuit

The 18-page complaint, submitted in a Washington court for the District of Columbia, states that the plaintiff was fired from the FBI academy last month because of earlier exhibiting the banner on his desk.

Per the complaint, the rainbow symbol was presented to Maltinsky to honor his contributions to support the FBI’s diversity initiatives.

Early on, my goal is serve the nation and safeguard public safety together with the talented and committed individuals at the agency,” stated Maltinsky.

He added, “I displayed that banner – which in 2021 was raised before a federal building – not as a political statement, but rather as an emblem of acceptance, solidarity and impartial service.

These principles that previously strengthened the bureau effective. Today it has become where people like me face discrimination. I think I was terminated not because of who I am, but rather because of what I represent: a homosexual man,” he concluded.

Sudden Termination Prior to Finish

In the past months, the employee was accepted into the federal agent course at Quantico, Virginia, until what he described as “abrupt dismissal only weeks prior to completion”.

The complaint also claims that eventually subsequent to Donald Trump’s inauguration, another employee expressed an alleged concern to the overseeing official about the exhibition of the LGBTQ+ symbol.

To be safe, the plaintiff requested that the top lawyer at the L.A. office review if the display of the symbol was acceptable,” the complaint said.

The document continued, “The Chief Division Counsel told Maltinsky that the display of the flag did not violate any bureau guidelines.”

Notification of Termination

However, on the first of October, Maltinsky was informed of his firing.

In correspondence referenced in the filing, bureau chief the official wrote, I decided that you demonstrated poor judgment with the presence of political signage in your work area during your previous assignment in Los Angeles.

“Pursuant to the Constitution of the U.S. Constitution, and the laws of the nation, your employment with the FBI is concluded.”

In a release released on Wednesday, his legal representative the attorney remarked, The current leadership’s illegal termination is a component of an extensive initiative to rid public offices of staff that possess alternative perspectives, or belong to minority populations, or those who oppose bias.

This battle is not just about him, but involves protecting the entitlements and freedoms of every government worker.”

Agency Response

The agency refused to respond about the legal action.

Maltinsky’s lawsuit follows a separate case lodged recently by ex- top agency personnel who said they were improperly dismissed.

They stated that Patel stated he had been ordered by the White House to dismiss any employee participating in a probe regarding the former president.

Additionally, the agency dismissed a nearly three-decade veteran in November subsequent to the director allegedly grew upset due to accounts that the bureau chief had taken an official aircraft to be present at a wrestling event during which his partner performed the Star-Spangled Banner.

The veteran, an agency staffer since 1998, was removed as head of the FBI’s critical incident response group, that handles major security threats and the agency’s jet fleet.
